Terms and conditions

These terms and conditions govern use of the zahnarzt.feedback platform, operated by 8am GmbH, Birkenweg 1, 9404 Rorschacherberg, Schweiz.

1. Scope of service

zahnarzt.feedback is cloud-based software for collecting, consolidating and responding to patient feedback. The exact scope depends on the plan booked.

2. Eligibility

Use is open to organisations in the dental and practice sector. The customer undertakes not to distribute unlawful content via the platform and to comply with applicable data protection and professional confidentiality obligations.

3. Data protection and processing on instruction

We process personal data of your patients as a processor on behalf of the customer. A data processing agreement under art. 9 revFADP, resp. art. 28 GDPR, is provided on request.

4. Availability

We target availability of 99.5 % as an annual average, excluding announced maintenance windows. No claim to uninterrupted availability arises from this.

5. Fees and term

Fees depend on the plan chosen. Unless agreed otherwise, contracts run for one year and renew automatically for a further year unless terminated 30 days before expiry.

6. Liability

8am GmbH's liability is limited to intent and gross negligence. No liability is accepted for indirect damage, data loss or lost profit.

7. Governing law and jurisdiction

Swiss law applies exclusively, to the exclusion of the CISG. The place of jurisdiction is Zurich.
